Terms of Service

These Terms of Service ("Terms") govern your access to and use of the HireTalent website and platform (the "Platform"), operated by HireTalent ("HireTalent", "we", "us", or "our"). By creating an account or otherwise using the Platform, you agree to be bound by these Terms.

• You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.
• You must provide accurate, current, and complete information when registering as a job seeker or employer.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• One account per person or company entity, unless otherwise agreed with us in writing.

You agree not to:

• Post false, misleading, discriminatory, or unlawful job listings or profile content.
• Use the Platform to harvest personal data, spam, or contact users outside the intended purpose of the Platform.
• Attempt to circumvent security measures, rate limits, or access controls.
• Upload malicious files or content that infringes on the intellectual property or privacy rights of others.
• Impersonate another person or entity, or misrepresent your affiliation with a company.

Employers may create and publish job advertisements ("job ads") on the Platform, subject to the following:

• Job ads must accurately describe the role, company, and requirements, and must comply with applicable Australian employment and anti-discrimination law.
• Job ads are published for the duration selected at checkout and expire automatically at the end of that period.
• Pricing is displayed in Australian Dollars (AUD) and, where applicable, includes GST in accordance with Australian tax law. A tax invoice is generated and emailed to the billing contact for each purchase.
• Billing details you provide (company name, ABN, billing address, contact email) must be accurate for invoicing and tax-record purposes.
• We reserve the right to remove any job ad that violates these Terms or applicable law, without refund, at our discretion.
• Fees are generally non-refundable once a job ad has been published, except where required by Australian Consumer Law.

• Profile information and resumes you upload must be truthful and belong to you.
• Applications submitted through the Platform are shared with the relevant employer; you are responsible for the accuracy of information you submit.
• You must not apply to roles using automated tools, bots, or bulk-submission methods designed to circumvent normal application review.
• We are not a party to, and are not responsible for, the hiring decisions, offers, or employment relationships between job seekers and employers.

You retain ownership of the content you submit (profile data, resumes, job ads, and messages). By submitting content, you grant HireTalent a limited, non-exclusive licence to store, display, and process that content as necessary to operate the Platform (for example, showing your profile to an employer you applied to, or displaying a job ad you purchased). HireTalent retains ownership of the Platform's design, software, and branding.

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by Australian law, HireTalent is not liable for indirect, incidental, or consequential damages arising from your use of the Platform, including but not limited to hiring outcomes, employment disputes, or data loss. Nothing in these Terms excludes any guarantee, right, or remedy that cannot lawfully be excluded under the Australian Consumer Law.

We may suspend or terminate your account if you breach these Terms, engage in fraudulent or abusive behaviour, or if required by law. You may close your account at any time via your dashboard settings or by contacting us. Sections relating to billing records, intellectual property, and limitation of liability survive termination.

These Terms are governed by the laws of Australia. Any disputes arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the courts of Australia.
